Eligibility Criteria: The Site is only available to individuals and others who meet imixu's eligibility criteria. This includes individuals who possess a valid credit/debit card issued by a bank acceptable to imixu, whose applications are deemed acceptable by imixu, and who have authorized imixu to process the total purchase price on their credit/debit card for the merchandise they wish to purchase. The products purchased from imixu are for personal or gift use only and should not be resold or used for commercial purposes or any other commercial benefit. imixu reserves the right to restrict the quantities of items being shipped to any individual customer or address.

Credit Checks and Information Sharing: By making a purchase offer, you expressly authorize us to perform credit checks as necessary and permitted by applicable laws. This includes transmitting or obtaining information (including updated information) about you from third parties, such as credit/debit card numbers or credit reports (including reports for your spouse if you reside in a community property jurisdiction), for the purpose of authenticating your identity, validating your credit/debit card, obtaining initial authorizations, and authorizing individual purchase transactions.

Orders

By placing an order on the imixu/i-mix-u website ("Site"), you agree to comply with the following terms and conditions:

Order Placement: To place an order, you must add desired items to your Shopping Bag, provide the necessary billing and shipping address information, select a delivery option, and choose a payment method. Completing these steps is necessary to finalize your order.
Order Acceptance and Availability: All orders are subject to acceptance and availability. Adding items to your Shopping Bag does not guarantee their reservation, as they may be purchased by other customers. imixu offers products for sale that are either in stock and available for dispatch from our distribution center or products that are ordered on demand.
Product Availability Notifications: If you have registered your email address to receive notifications about the arrival of a specific product featured on our Site, we will make reasonable efforts to notify you by email within 48 hours of the product becoming available for purchase. However, please note that certain high-demand products may sell out during this notification period.
Transaction Records: imixu will maintain a record of your transactions for a minimum of one year. This record will include details such as the items purchased, transaction dates, and payment information. We may retain this information for longer periods as required by law or for legitimate business purposes, as outlined in our Privacy Policy.

 

 

Pricing

Currency and Inclusive Taxes: The prices displayed on the Site are shown in Singapore Dollars, unless otherwise specified based on the country/region you are shipping to. These prices include the Goods and Services Tax (GST) at the applicable rate, unless you have selected a country where VAT is not chargeable.
Price Adjustments: Prices may be subject to change due to various factors, including fluctuations in currency exchange rates, markdowns, and other commercial considerations. The price applicable to your order will be the price in effect at the time your order is accepted.
Import Duty and Tax: Customers purchasing from a country served as DDP (Delivery Duty Paid) will incur relevant import duty and tax. These costs are included in the final purchase price. If your credit/debit card is not denominated in Singapore Dollars, the final price will be calculated based on the applicable exchange rate on the day your card issuer processes the transaction.
Regional Affiliate Companies and International Transaction Fees: Depending on your shopping destination and the currency you use, your purchase may be processed by one of our regional affiliate companies. In such cases, your bank may impose an international transaction fee. Please note that imixu is not responsible for any fees or charges levied by your bank in connection with the international transaction.

 

Acceptance of order

 

After placing your order, you will receive an email acknowledging the details of your order. Please note that this email is not an acceptance of your order, but a confirmation that we have received it. On the order confirmation page, we will provide an order summary for each product, including the price (inclusive of fees and taxes) and shipping cost. Your order represents an irrevocable offer to purchase the products. Before proceeding with the purchase, please review the order details and correct any possible errors.

Unless you cancel your order, acceptance of your order and completion of the contract between you and imixu will occur when we email you to confirm that the goods have been dispatched. The English language governs the finalization of the contract. Our third-party payment processor and courier do not have the authority to accept orders on behalf of imixu.

Right to Refuse Orders: We reserve the right not to accept your order in certain circumstances. This includes situations where payment authorization cannot be obtained, shipping restrictions apply to a specific item, the item is out of stock or fails to meet our quality control standards and is withdrawn, or you do not meet the eligibility criteria outlined in the Terms of Service (TOS).

Refusal of Transaction or Service: We may refuse to process and accept a transaction or refuse service for various reasons, including non-compliance with our business policies or suspicion of fraudulent or illegal activity. In such cases, we will not be liable for refusing to process a transaction or for any subsequent unwinding or suspension of a transaction after processing has begun. We also reserve the right to withdraw any merchandise from the Site, regardless of whether it has been sold, and to remove, screen, or edit any materials or content on the Site. We do not accept orders from users acting for commercial and professional purposes.

Pricing Errors: While we strive to ensure the accuracy of pricing information on our website, occasional errors may occur. If a patent pricing error is discovered for a product in your order, we will notify you as soon as possible. We are not obligated to accept or fulfill an order for a product advertised at an incorrect price, provided that the error was recognizable. We reserve the right to cancel such an order that has been accepted or is in transit. If you have already made payment, we will promptly refund the full amount. If products are recalled in transit, we will process your refund upon receipt of the returned products.
Payment

 

Accepted Payment Methods: Payment can be made using Visa, MasterCard, American Express, Maestro, JCB cards, and other methods advertised on the Site. You may also choose to pay with Google Pay or Apple Pay.
Payment Processing: Upon completing the transaction, you will be redirected back to i-mix-u.com. Payment will be either debited and cleared from your account upon order dispatch or processed within five days from the date of purchase, whichever is earlier.

Authorization and Validation: By using a credit/debit card for payment, you confirm that the card belongs to you or that you have explicit authorization from the card owner to use it. All card transactions are subject to validation checks and authorization by the card issuer. We are not liable for any delay or non-delivery if the card issuer refuses to authorize payment to imixu.

Credit/debit card transactions are processed through a secure online payment gateway that encrypts your card details in a secure environment. If you are a registered imixu user, your card details will be securely stored and encrypted for processing initiated by you.

Secure Shopping Experience: imixu utilizes Secure Socket Layer (SSL) technology to ensure the safety, simplicity, and security of your shopping experience. While we take reasonable care to maintain the security of your order and payment details, we cannot be held liable for any loss you may suffer if a third party gains unauthorized access to the data you provide while accessing or ordering from the Site, except in cases of our negligence.

Delivery

Delivery Location and Time: We strive to deliver your purchase to the specified delivery location and within the indicated delivery date and time provided during the order checkout process. Delivery times mentioned on the Site are estimates and should be used as a guide, starting from the date of dispatch. In any case, we will deliver the goods to you within 21 days from the date of order acceptance. Please note that destination customs clearance processes may cause delays, for which imixu is not responsible.

Notification of Delay: We will make reasonable efforts to inform you if we anticipate being unable to meet the estimated delivery date. However, to the extent permitted by law, we shall not be held liable for any losses, liabilities, costs, damages, charges, or expenses arising from late delivery.
Delivery to Certain Locations: In some cases, it may not be feasible for us to deliver to certain locations. If this situation arises, we will notify you using the contact details provided during the order placement process. We will arrange for either order cancellation or delivery to an alternative address as per your preference.
Receipt and Documentation: Upon delivery of your order, you may be required to sign a delivery receipt. You should keep the documents delivered with your order and provide them upon request.

Prohibited Actions: Reproduction or redistribution of the Content listed above, including third-party trademarks, designs, and related intellectual property rights, is strictly prohibited and may result in civil and criminal penalties. Copying and using the listed materials on any other server, location, or for publication, reproduction, or distribution is expressly prohibited. However, you are allowed to make one copy of the Content for personal viewing purposes.
Personal Opinions: The personal opinions expressed by designers, labels, or any third parties associated with imixu are their own and do not necessarily reflect the views of imixu. We accept no responsibility for any views expressed by them in any media.

Personal Non-Commercial Use: This Site is intended for your personal, non-commercial use only. You are strictly prohibited from engaging in any activities that involve the modification, copying, distribution, transmission, display, performance, reproduction, publication, licensing, commercial exploitation, creation of derivative works, transfer, data mining, or sale of any Content, software, products, or services found within this Site.

You are not allowed to use this Site or any of its Content to further any commercial purpose, including engaging in advertising or generating advertising revenue on your own website.

 

Your Responsibility

Please note that imixu has not reviewed all of these linked sites and is not responsible for the content or accuracy of any off-site pages. We do not endorse the external websites or resources, nor are we responsible or liable, directly or indirectly, for their privacy practices or content. This includes any advertising, products, or materials available on or through such external websites or resources. Any damage, loss, or offense caused or alleged to be caused by or in connection with the use of or reliance on such content, goods, or services is the sole responsibility of the user, to the extent permitted by applicable law.

 

 

Your rights

You have the right to expect that any products you order through this Site will be of satisfactory quality, fit for their intended purpose, and conform to any descriptions provided on this Site, in accordance with applicable law.

Remedies for Defective Products: In the event that a product is defective, you have certain remedies. Subject to the mandatory consumer protection provisions, all products sold by imixu are covered by a 1-month guarantee for lack of conformity. If you notice a fault within 1 month, please contact Customer Care. In case of lack of conformity, you may choose between a repair or a replacement of the product. If these options are not available, you are entitled to request either an appropriate reduction in the price or termination of the contract. These remedies are in addition to any rights granted under applicable law.

Nothing in the Terms of Service (TOS) is intended to affect your statutory rights as granted by applicable law.

 

Force majeure

Events Beyond Our Control: We shall not be held responsible for any failure to fulfill our obligations under the TOS if such failure is due to events beyond our reasonable control.

Termination in Case of Prolonged Force Majeure: In the event that a Force Majeure event lasts for more than one week, either you or we may terminate the Contract by providing written notice. In such cases, neither party shall be liable, except for the refund of any product payment made by you but not yet delivered. If we are unable to fully meet our obligations to you due to a Force Majeure event and have multiple contracts with other customers, we may, at our absolute discretion, decide which contracts to perform and to what extent. We retain the absolute discretion to determine the solution for fulfilling our obligations under the Contract, notwithstanding the occurrence of a Force Majeure event.

 

Waiver

No failure or delay by either party in exercising any right under these Terms and Conditions or a Contract shall constitute a waiver of such right or any other rights. It shall not extend to or affect any other or subsequent event, impair any rights or remedies, or modify or diminish the rights of either party under these Terms and Conditions or a Contract.

 

Governing law and dispute resolution

These Terms and Conditions and any Contract, including any non-contractual obligations arising from or related to them, shall be governed and interpreted in accordance with the laws of Singapore. Both parties hereby agree to submit to the non-exclusive jurisdiction of the courts of Singapore. All communication, correspondence, and interactions between us shall be conducted in the English language.
